Question:

I have just been sent a letter from a local trustee stating that he had another bankruptcy petition preparer who he thought over charged and told me I can only charge$175.00 per bankruptcy petition and that I have to pay back the $250.00 which was cause it was expedited and she had many creditors. Can you help me?

Answer:

We STRONGLY recommend against working as a Petition Preparer, and instead, working as a Virtual Bankruptcy Assistant (VBA).

The difference is that a Petition Preparer works directly for the debtor, whereas a VBA works for one or more attorneys.

The main reasons we recommend not working as a Petition Preparer, is that a Petition Preparer is at GREAT risk of being accused of practicing law without a license, and as you’ve learned, Petition Preparers are highly regulated, and are limited in what they can charge, as you have learned the hard way.

Furthermore, after you have an attorney sending you work, you typically have a stream of work that you don’t have to go out and find.

So to answer your question, no, we can’t help you keep the $250 that the trustee has ordered you to pay back.

We recommend that you consider switching your business model over to being a VBA.

Good Morning

I am very interested [in becoming a Virtual Bankruptcy Assistant].  I just relocated to Albany , NY for a paralegal position with a law firm as an elder law paralegal well needless to say they were not looking for a paralegal with close to 25 years experience.   I have a 4 years Bachelor’s degree and a year of law school.

I just moved back to the USA approx 3 years ago after living abroad and never thought I would have such a hard time finding a position.  For the past 3 years I have worked for an agency as a contract paralegal getting paid $16 an hour with no benefits. People keep telling me be thankful I have a job but I can’t be so stressed out, bored and unhappy.

I have been looking at the Virtual Bankruptcy for a little while but being a single parent and limited funds I was not sure how much money I would need to start up such a venture.

Would love to know more just like Monica and Michael.  I want a better life for my daughter and I and at 50 I do want to go back to law school and finish what I started so long ago.

For those on a budget, there are 3 of our training materials I highly recommend getting either one at a time, or together, that will give you enough training and knowledge to draft Chapter 7 petitions.

Then once you’re earning money, you can augment your training, including going through some of the Chapter 13 training.

Question:

I recently completed the online ch 7 class and am currently taking a ch 13 class.  In February I purchased the complete training kit (books, videos, etc) which also included a paper VBA exam.

Do I use the paper exam included in the training program, or do I take it online now?

Answer:

Thank you for your inquiry.

The paper version of the VBA certification exam was discontinued earlier this year, at which time, the exam was updated, improved, and is now taken online.

You can register for the exam at www.713training.com/products/VBA-Certification-Exam.html.  After doing so, you will be able to download the instructions for the exam.

The exam is broken out into 15 sections.  Each section is timed, giving you fifteen minutes to more than an hour per section, (which is ample time, if you are adequately prepared), so once you start a section, you will need to complete it within the time given, but you will have 30 days from the time your register to complete all 15 sections of the exam.

When the exam was updated, the company policy was also changed to allow two attempts at taking the exam (the original policy only allowed one attempt), so that if the exam isn’t passed on the first attempt, it may be taken again after six months have elapsed.

We find that most people that have studied our book titled “How to Start a Virtual Bankruptcy Assistant Service”, and our “How to Draft a Bankruptcy Petition” videos, do well on the exam.
