One Year Anniversary

Marking the One Year Anniversary of My Near Death Experience

For those of you who were customers this time last year, you may remember me publishing the article regarding my near-death experience. As many of you are aware, God intervened in my life and two angels appeared to me just before I came out of the 3 week coma that almost took my life. I wrote about the experience and published it as a testimony to Jesus Christ.

Insider, No Cost Marketing Tips for Virtual Bankruptcy Assistants

INSIDER MARKETING TIP – NO COST TO YOU

Social networking is the new buzz word for marketing on the internet. Once you sign up to join these communities (which is free), you build a profile and the search engines will pick up your listing. This means that you get free advertising for your virtual bankruptcy assistant business and all it takes is a few minutes of your time.

But there is a catch . . .

You need to spend a few minutes a build a profile so that the search engines and the community can identity your interests and list you properly so others can find you. Think of it this way. Do you remember the old card files back in the old days used by the library? If you wanted to locate a book on starting a business you went to the card file. You located the main category of business. Next you looked under subdirectories until you found categories like: entrepreneur or starting a business.

This is only one small example; however, search engines break down the categories even more so that people can quickly find what they are looking for. For example, if you were looking for a stuffed cow for your grandchild you certainly don’t want to look at taxidermy websites. That is why the search engines are so highly categorized into category after category after category. And the words you use on your social networking website will be picked up by the search engines and placed in a certain category within the search engine itself.

Note: Remember to NEVER use your social networking website for personal purposes, use it for business purposes only. Let me explain how to do this:

UPLOAD YOUR PHOTO

When you upload your photo, type in a title like: Virtual Bankruptcy Assistant so these words will appear under your photo. This way, the search engines will pick up on the words virtual, bankruptcy and assistant.

DON’T HAVE A PHOTO?

Take one with your digital camera and size it down to a 72 dpi (dots per inch) for fast loading on the internet. DO NOT use high resolution photos on the internet because they are too large and take too long to load. Then, make plans to go to Wal-Mart and have a photo taken for $15.00 or so. It is important to have a photo to promote your company. Why? Back in the old days, if someone walked into a store to buy something they could see real people. At your internet store people cannot see you before buying anything. A photo helps people to see you are a real person and build more faith in your business services and products.

PROVIDE A PROFILE

Do not provide information about your family, kids and dogs. This will do nothing for your business. Instead, provide a profile that says something like:

Jane Doe is a virtual bankruptcy assistant who provides professional Chapter 7 and Chapter 13 bankruptcy petition preparation services to attorneys across the United States. Jane Doe received her training from 713Training.Com and is a member of the National Association of Virtual Bankruptcy Assistants at www.navba.org. You can view Jane Doe’s company website at www.mywebsite.com

All of these crucial keywords like: attorney, bankruptcy petition, Chapter 7, Chapter 13, and so forth; are essential to categorizing your listing properly in the search engines.

ADD MORE WEBSITE LINKS

Remember to add your website link to your profile as well as links to other websites that operate within your nitch. DO NOT include the website link of your grandchildren or anything else personal. Remember to stick to business information only. If you want to display photos of your grandchildren and just play around, develop a separate profile under a different email address.

If you are a member of the NAVBA, remember to add http://www.navba.org and if you received your training through 713Training.Com, remember to add http://www.713training.com I am not telling you to do this because I am trying to advertise on your social networking website. JOIN GROUPS

In every social networking website you join, remember to search for and join groups. This is basically the reason you join a social networking website; to network with people who have your same business interests. First, search for groups using the search word (bankruptcy). If there are none, try (legal) then (law) then (paralegal) then (virtual assistant) then (business). Join the groups with the largest number of members that fit this criteria and everyone in the group will be exposed to your company and visit your website for more information about what you do.

Although many of us do not have a lot of time, it really is to your benefit to take a moment and post a message to the groups that you join to tell others about your company. DO NOT use this as a chance to advertise. If you do, you will blow the opportunity for free exposure. You may want to post something like:

Hello everyone. My name is Jane Doe. I just joined this group and I am interested in networking with others who work in the legal field or operate their own home business. I would like to share marketing techniques and learn more about how you grow your business. I am willing to share any information I have that will help you also.

Notice that the posting above provides a two-way street. You do not come across as a selfish person who is only interested in what you can get from others, but rather you are also willing to share information to help others also. This opens up the door for you to be accepted by the group and people will be more willing to contact you. You will become interesting instead of appearing like a selfish nut only interested in pushing your service down every persons throat. The types of people you want to attract and network with avoid people who are rude and selfish; so take steps not to appear that way.

SEARCH FOR AND ADD FRIENDS

In addition to searching for and joining groups, make sure you also search for friends that have the same interests you do. Every social networking website has a search function for you to search on a specific keyword like: business, legal, attorney, paralegal, bankruptcy, entrepreneur, etc. When you find people within these groups, invite them to join your Friends List and build up a network of your own. Again, this exposes you and your business to even more contacts.

Beware of New Bankruptcy Fraud Scheme

I just received the following announcement from the Clerk of Court for the Southern District of Ohio. Please read, pass along and be aware:

FRAUDULENT SCHEME INVOKES FEDERAL BANKRUPTCY COURT

The federal court system has become aware of a fraudulent scheme that may be affecting victims throughout the country. In it, persons are called and told they owe money, typically $150 to $450, to pay the debt of another person.

In several recent instances in Utah, individuals who refused to provide a credit card number to the caller were told they must report to a federal bankruptcy court for a hearing, and that if they did not pay they would be arrested.

The caller also provided a toll-free number for the individuals to call if they decided to pay by credit card instead of reporting for the hearing.

Federal bankruptcy courts do not initiate such calls. This matter is under investigation by the United States Marshals and the U.S. Postal inspectors. It has also been reported that these calls are placed by an automated voice messaging system which is in no way affiliated with the court.

If you receive one of these calls, please record the number (if possible), write down as much information as possible, and contact the Bankruptcy Court.

Update to Means Test Bankruptcy Petition Form

The Means Test, a form within the Chapter 7 bankruptcy petition was updated on December 19, 2008. This change is very minor. In a nutshell, a check box and Part 1C was added for debtors who are entitled to claim the Reservists and National Guard exclusion. Below is the Committee Note provided by the US Bankruptcy Court regarding this change:

Form 22A

The Chapter 7 form is amended to implement the temporary exclusion from Means Testing created by the National Guard and Reservists Debt Relief Act of 2008. That law amended Section 707(b)(2)(D) for a period of three years by adding a new Subsection (ii) to provide a temporary exclusion from the application of the Means Test for certain members of the National Guard and reserve components of the Armed Forces. The new temporary exclusion would last for the period that the qualifying debtor is on active duty or is performing a homeland defense activity, and for 540 days thereafter.

Because the exclusion for Reservists and National Guard members applies only for a defined period of time, it may expire during the course of the Chapter 7 case filed by a debtor initially entitled to the exclusion. For that reason, a new check box is added to the top of the form that states that the “presumption is temporarily inapplicable.” A debtor who is entitled to claim the Reservists and National Guard exclusion at the commencement of the Chapter 7 case may check that box.

The new exclusion applies only to a debtor who satisfies all of the requirements of Section 707(b)(2)(D)(ii), and its expiration date depends on facts specific to each debtor. Therefore, in a joint case in which the exclusion in Part 1C is claimed by either or both filers, each joint filer must complete a separate statement. If only one joint debtor qualifies for the exclusion in Part IC, the other joint debtor must complete the form.

Part 1C is added to the form to allow qualifying debtors to claim the temporary exclusion under Section 707(b)(2)(D)(ii). Debtors who declare under penalty of perjury that they satisfy all of the requirements of that provision are directed to verify their declaration in Part VIII and to check the “temporary presumption” box at the beginning of the form. They are not required to complete the remaining parts of the form for so long as the exclusion remains applicable.

A debtor who is or has been a Reservist or a National Guard member may qualify for the exclusion described in Part 1C by being called to active duty service after September 11, 2001, for a period of at least 90 days, or while performing homeland defense activity for a period of at least 90 days. After the debtor has been released from active duty or has ceased performing homeland defense activity, the exclusion applies for a period of 540 days after the release date or cessation of homeland defense activity. Under those circumstances the debtor must state the date of release from active duty or the date on which the performance of homeland defense activity terminated.

If the Reservist and National Guard exclusion terminates during the course of a Chapter 7 case – because of the expiration of the 540 day period following the release from active duty or the cessation of homeland defense activity – then the debtor may be required to complete the remaining parts of the form that are applicable to the debtor. If the exclusion terminates while a timely Motion to Dismiss under Section 707(b)(2) may still be filed, Interim Rule 1007-I(n) requires that the debtor complete the remaining parts of the form no later than 14 days after the termination. If the obligation to complete the form arises in these circumstances and the debtor has not previously completed the form, the clerk is required to give the debtor notice of the obligation.

As you may already know, I have been working since March 2008 traveling to law firms and setting up new bankruptcy practices. Some attorneys wanted to keep their bankruptcy petition work in-house so I trained their employees. Other attorneys wanted to stay small and do their own petitions, so I trained the attorneys how to prepare their own petitions. However, some attorneys wanted to start or expand a practice and use virtual bankruptcy assistants. For these attorneys I matched them with VBAs who had passed the VBA Certification Exam.

Bankruptcy Federal Forms Update

On December 1, 2008, updates to the federal forms were implemented. The changes will appear minor to virtual bankruptcy assistants but show the changes in the law which affect the attorneys and the courts practicing law.

NOTE: Some changes and revisions were made to forms used in a Chapter 11 case, which I have not included in this article. For purposes of this article, I have only included changes that effect Chapter 7 and Chapter 13 bankruptcy petitions.

EXHIBIT D
Individual Debtor’s Statement of Compliance with Credit Counseling Requirement

Paragraph 3 of Exhibit D was amended to delete any reference to a requirement that a debtor file a motion with the court to obtain an order approving a request for the postponement of the debtor’s obligation to obtain a credit counseling briefing prior to the commencement of the case. The paragraph immediately following numbered paragraph 3 was also amended to reflect the deletion of the need for a separate motion beyond the completion of the certification itself. That paragraph continues to warn the debtor that the case may be dismissed if the court does not find that a postponement is warranted. It also advises the debtor that, even if the court concludes that postponement of the obligation is appropriate, the debtor still must complete the briefing within the time allowed under the Code.

FORM 8
Chapter 7 Individual Debtor’s Statement of Intention

This form is amended to conform to Section 362(h), which was added to the Code, and Section 521(a)(2), which was amended, by the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, Pub. L. No. 109-8, 119 Stat. 23 (April 20, 2005), by expanding the questions directed to the debtor regarding leased personal property and property subject to security interests. This form is also amended and reformatted to require the debtor to complete a series of statements describing the property and setting out what actions the debtor intends to take for each listed asset. The amended form is intended to elicit more complete information about the debtor’s intentions with regard to property subject to security interests and personal property leases than has been obtained under the current version of the form.

In addition, this form is amended to specify that the debtor’s signature is a declaration under penalty of perjury, as required by Rule 1008, and to provide space for the co-debtor’s signature. A continuation page has been provided for use if necessary. The Declaration of Non-Attorney Bankruptcy Petition Preparer has been deleted from the form as duplicative of Form 19, Declaration and Signature of Non-Attorney Bankruptcy Petition Preparer. Form 19 contains both the petition preparer’s declaration and signature and the notice the petition preparer is required to give to the debtor under Section 110 of the Code.

FORM 10
Proof of Claim

This form is amended at Box 7 on Page 1, and instructions 2 and 7 on Page 2, to instruct the claimant that the information contained in or attached to a claim based on the delivery of health care goods or services should be limited so as to avoid embarrassment or the unnecessary disclosure of confidential information. The claimant is informed that additional disclosure may be required if the trustee or another party in interest objects to the claim.

Page 2 of the Proof of Claim is also amended to revise slightly the definitions of “creditor” and “claim” to conform more closely to the definitions of those terms in the Code.

FORM 23
Debtor’s Certification of Completion of Post-Petition Instructional Course Concerning Financial Management

The paragraph describing Filing Deadlines at the bottom of the form was revised to include a reference to Section 1141(d)(5)(B).

FORM B201
Notice to Consumer Debtor

Clerks of the court may use Form B201 to give individual consumer debtors the notice required by Section 342(b) of the Code (11 U.S.C. Section 342(b)) or to respond to general inquiries from the public.

This form serves as a pre-printed information sheet on the purposes of Chapters 7, 11, 12, and 13 of the Bankruptcy Code, the costs and benefits to the debtor of a case under each Chapter, the types of services available from credit counseling agencies, and warnings about the penalties for bankruptcy crimes and the Attorney General’s examination of information supplied in connection with a bankruptcy case.

Form B201 states that joint debtors who list the same mailing address on the bankruptcy petition will generally receive a single copy of each notice mailed from the bankruptcy court in a jointly-addressed envelope, unless the debtors request that each spouse receive a separate copy of all notices. Form B201 also advises debtors that Fed. R. Bankr. P. 4002 requires the debtor to notify the court of any changes in the debtor’s address.

Although there is no specific requirement that Form B201 itself be filed, the debtor may file a signed copy of the form with the petition in order to avoid questions about whether the notice has been given.

FORM B283
Chapter 13 Debtor’s Certifications Regarding Domestic Support Obligations and Section 522(q)

Form B283 may be used by debtors to certify that they have complied with two of the requirements set out in Section 1328(a) of the Bankruptcy Code, 11 U.S.C. Section 1328(a), for a discharge in Chapter 13. The certifications must be made after the debtor has completed the plan payments.

Before completing this optional form, the debtor should determine whether the court has adopted a local form for making these certifications. If the court has adopted a local form, the debtor should use that form instead of Form B283. Information on the court’s local rules and forms is available on the court’s website.

Bankruptcy Filing Statistics

BANKRUPTCY FILING ARE NEAR THE MILLION MARK

I just received a newsletter sent to members from the bankruptcy court that I wanted to share with you:

A total of 967,831 bankruptcy cases were filed in the 12-month period ending June 30, 2008, according to statistics released by the Administrative Office. The nearly one million filings represent a 28.9 percent increase compared to the previous 12 months, when 751,056 cases were filed. Total filings increased in 86 of the 90 bankruptcy courts.

Filings in the three months of April, May, and June totaled 276,510, up 12.5 percent from the 245,695 filings in the preceding three months. The 276,510 filings represented the highest quarterly filings since the last three months of 2005, which included part of the surge in filings just before the effective date of many of the provisions of the BAPCPA on October 17, 2005.

Chapter 7 filings totaled 615,748, up 36.7 percent in the 12-month period ending June 30, chapter 13 filings totaled 344,421, up 16.9 percent; and chapter 11 filings totaled 7,293, up 30.6 percent. Chapter 12 filings fell 18.7 percent, dropping to 314. Chapter 7 filings increased in 88 of the 90 bankruptcy courts, chapter 11 filings increased in 68 courts, and chapter 13 filings increased in 79 courts.

The 934,009 non-business filings represented an increase of 28.4 percent. Businesses were up 41.6 percent, for a total of 33,822. The Central District of California had the largest numerical increase in total filings, in chapter 7 filings, and in chapter 13 filings during the 12 months ended June 30.
