Behind the Scenes at 713Training.Com

Personal Note from Victoria Ring

Hello Everyone.  October has been a wonderful month to live in Colorado.  As many of you know, I moved 713Training.Com from Ohio to Colorado in February 2009 because it had been a lifelong dream of mine to live in Colorado Springs.  Therefore, this has been the first time I have experienced Colorado during the month of October and it has been quite amazing.  When I lived on the east coast the Fall colors consisted of greens and yellows.  In the west, the earth is colored in a southwestern flair; dark yellows, dark reds and browns.  It is absolutely breathtaking.

For those who know me personally, I am a nature freak.  Nothing thrills me more than to go out driving amid 14,000 foot tall mountains and watching elk drink from the Rio Grande.  Nothing is more beautiful to me than the views along The Highway of the 14ers in Buena Vista or driving to altitudes of almost 10,000 feet on Highway 67 between Divide and Cripple Creek.  Words cannot describe the beauty of Colorado and it has been an inspiration to my writing resulting in a positive impact on my business.  I look forward to much more in the months ahead.

My Next Speaking Event

I will be leaving Thursday, October 22 to fly to Seattle, Washington.  I will be speaking at the Washington State Paralegal Association CLE Conference.  My topic is: Bankruptcy Law Update and What Paralegals Should Know About Creditors Perspectives.  I have spent most of the weekend writing an outline and preparing a handout for the attendees.  Since it takes about 4 hours to fly from Denver to Seattle, I will have plenty of time to practice my speech, which is scheduled to be 90 minutes in length.

Is 713 considering investors?

I was shocked this past week to receive 4 different emails asking if I would be interested in talking with investors about the growth of 713.  This is very flattering.  Of course I am always interested in entertaining ideas of how 713 can grow to the next level but so far, no one has made any offer that makes good sense to me.

One company wanted me to consider taking the operation to India.  I have a hard time with that one.  Perhaps I am from the old school, but I think most attorneys and clients would feel very odd about having their bankruptcy petition prepared in another country.  My first concern would be security.  Debtors expose their social security numbers, account numbers, employer names, and other confidential data in a bankruptcy petition.  Although it is public information I do not think many debtors would be happy to know that the information was being sent to India.

Besides, I do not think a bankruptcy petition can be prepared correctly utilizing the mentality of a document mill.  Often, investors view preparing bankruptcy petitions as nothing more than data entry.  THIS IS NOT THE CASE.  And for those of you who have read my training materials, you know there is much more to preparing a petition than filling out forms.  You have to be properly trained, know how to conduct online research, interview clients and much, much more.  I just do not think all of this can be done properly outside the United States so I declined this offer.

Motion to Avoid Secure Lien and Strip Second Mortgage

When I first learned of a Motion to Avoid Secure Lien and Strip Second Mortgage I was doing a petition review for an attorney.  I was told that many courts are requiring that the attorney file a Motion to Avoid Secure Lien along with the Chapter 13 Plan if they intend to propose a stripped mortgage due to unsecure equity.

The attorney I was doing the bankruptcy petition review for did not have a copy of the Motion so I conducted online research to find the pleading for her. During my research I found that <at this time> there is not one specific Motion that is used for all fifty states.  Instead, it is a pleading with a variety of different titles, making it difficult to find.  This of course is due to the fact that the government is still debating the issue regarding the mortgage industry at this period in our history.

During my research I found an excellent article on the USFN website written by attorney Ken Plott of Lundberg & Associates.  Due to copyright infringement I do not have permission to reprint the entire article for you. However, I can quote the following facts from Mr. Plott’s article:

1.   Bankruptcy Code 11 U.S.C. Section 1322(b)(2) provides that a Chapter 13 plan may modify the rights of secured creditors, with the exception of <a claim secured only by a security interest in real property that is the debtor’s principal residence.>

2.   The courts determined that the standard language in a trust deed or mortgage about <assignment of rents and escrow> does not jeopardize the anti-modification provision.

3.   The U.S. Supreme Court in Nobelman v. American Savings Bank, 508 U.S. 324 (1993), analyzed the interplay between Section 1322(b) and Section 506(a) and determined that bifurcation was not proper as it would modify the rights of the secured creditor in contravention of Section 1322(b)(2). However, the court did not address the impact of Section 506(a) upon Section 1322(b)(2) when there is absolutely no value remaining in the collateral securing the claim.

4.   It is fair to say that a majority of the jurisdictions now allow a wholly undersecured claim to be stripped and treated as an unsecured claim in a Chapter 13 plan. Some jurisdictions allow this to be done with a provision in the plan while others require an adversary proceeding to comply with Bankruptcy Rule 7001(2), a proceeding to determine the validity, priority or extent of a lien.

Update on NAVBA Annual Picnic

Held on September 5, 2009

Originally two people signed up to attend the NAVBA Annual Picnic but only one person showed up.  At first I was a little disappointed but I realize that it was the holiday weekend and many of our members live outside Colorado.  However, everything turned out for the best.  Since Robin Harvey was the only VBA to show up, I had the opportunity to get to know Robin on a personal level.  This would have never happened if she would have been part of a group.  Robin also agreed that all of this happened for a reason.

Besides, Robin and I had an absolute blast.  We began the day taking a tour of Manitou Springs.  This little community of about 5,000 people was bombarded with tourists over the Labor Day weekend.  There were celebrations being held on almost every street corner of this cool little town.  But since I am a local resident, I was able to take Robin to less crowded places that tourists do not go.  She loved it.

After the Manitou Springs tour I took Robin to the Garden of the Gods.  In fact, I bring everyone to the Garden of the Gods when they come to visit me.  This is one of the most awesome places you can see in Colorado Springs and admission is free.  Since words cannot describe the beauty of this area, if you are interested in viewing photos of the Garden of the Gods, visit:

Next, we drove to Cripple Creek, Colorado.  Cripple Creek is a smaller version of Las Vegas and was filled with a lot of excitement.  Although Robin and I do not gamble, we knew the restaurants would serve good food since they cater to a gambling type crowd.  Our suspicions were right; the pizza and salad were excellent and we were there to hear someone win $9,485.00 in cash while we were eating.  It was exciting!

As we were leaving Cripple Creek we noticed a history tour of the town by train.  We took the trip and it was so much fun.  The train tour took us up to the 10,000 foot (above sea level) mark.  We viewed a lot of different gold mines and most of them generated from $2 million to as high as $37 million for their owners. The mines generated gold from the early 1800s until just before World War II.  That is a long time!!  So, when you hear the phrase [There is gold in them there hills] you can believe it.

Other than the gold mines, the thing that amazed me was the difference in the atmosphere at 10,000 foot versus 5,000 foot (the altitude in Denver).  The trees are much thinner, the temperature drops significantly and there are absolutely no bugs flying around.  Additionally, the wind constantly blows but the views of the mountain ranges are so magnificent that I did not care.  When I look at this type of beauty that is beyond words I always acknowledge God as the greatest artist in existence.  His work is always awesome but I think it is especially awesome at 10,000 foot above sea level.

By this time Robin and I were both very tired.  We drove to downtown Colorado Springs and ate dinner at the Phantom Canyon Brewing Company.  In my opinion, this place has the best fish and chips dinner in southern Colorado.  Check out their website at:

The next day, Robin had to leave to go back to California.  I drove her to the Denver airport so that we could spend some extra time together.  I was so impressed with Robin.  She has been with 713Training.Com since the early days (2004.)  Although she may not have decided to take an active part into building her virtual bankruptcy assistant business until now, she has purchased all the training products, followed all the discussions, subscribed to all the newsletters and even has a print out of all these materials which are placed into binders and categorized in her office.  Wow!  I was totally impressed that she cared so much about her career that she went to these measures to preserve the training materials.  This was why I offered her a choice of Board Member positions within the VBA.  There is no doubt that Robin will work hard to help the NAVBA grow.  Take a moment and view her photo and contact information at:

Summary

Upgrade to VBA Certification Exam

We are happy to report that the popularity of the VBA Certification Exam is growing. In fact, it is growing so rapidly that we have had to implement a change in the way Part 2 is graded. We hope these changes will result in a better turnaround process as well as a better grading system for our Certified VBAs.

In the past, people downloaded Best Case software, prepared a bankruptcy petition and emailed the Best Case file to us. Next, we scheduled a live conference and graded the bankruptcy petition skills of the VBA.

One of the major problems with this process was that some people did not use Best Case software. They were forced to learn another software program versus the one they were using. We do not believe it is fair to force a VBA to test on software they are not familiar with. Besides, we only need the print out of the bankruptcy petition itself. It does not matter to us which software program you use for the Exam.

Secondly, scheduling conflicts prevented us from meeting with the VBAs and conducting the meetings at convenient times. In many instances, we would go back and forth with scheduling conflicts for 1 or 2 weeks while the VBA waited for their grade. Also, due to heavy call volumes, Victoria Ring would try to schedule Part 2 VBA reviews in the evenings. Due to time zone changes, the evenings could be very late for some VBAs and early mornings were also a problem.

The Solution

The solution to these problems has now been solved. VBAs can now use any bankruptcy software program they want to take their VBA Certification Exam and VBAs will no longer need to schedule a meeting to review Part 2 of the Exam. Instead, VBAs will prepare the petition in the software program they are most comfortable with. When finished, they simply print the bankruptcy petition as a PDF and the actual Federal Forms and Schedules are graded on 40 specific areas.

After the grading of Part 2, an average score is obtained by adding up the score for Part 1 and Part 2; then dividing by 2. Also, a 10% bonus award is granted on Part 2 if the VBA successfully can send the document by email in PDF format. The reason this step provides bonus points is because in the real world, a VBA will normally email a PDF to the attorney for review. We need to ensure the VBA has this skill and this step in the grading process will verify that.

VBA Scores Appearing on the Front Page of the NAVBA Website

A complaint we had with VBAs who passed the VBA Certification Exam is that their score was listed on the front page of the NAVBA website. This is okay for people who achieved a score of 90% or higher; but if a VBA earned a lower score, they were not happy that it appeared for the entire world to see.

For a better understanding, let me explain the reason why the VBA Certification Exam scores appeared there in the first place. In the beginning I listed people who passed the Exam in alphabetical order. But people complained. They wanted to be listed near the top and would name their company something like AAA Petitions just to be there. I felt this was creating unnecessary competition and tried to come up with a solution.

Next, attorneys were calling, asking me who scored the highest on the VBA Certification Exam. I could not remember off the top of my head the scores for everyone, so I had to tell them to go through the list. Naturally, the attorney started at the top of the list and those who were near the bottom were never contacted for work. Again, the system was unfair and I knew I had to come up with a solution.

That is when I decided to start listing VBAs in the order of their score on the VBA Certification Exam. But now, this has caused a problem for those scoring lower than 90%. In fact, we actually have people who try and manipulate their score just to get near the top. For example, some people will take up a great deal of our time, arguing with us that the answers we have are wrong. Even after explaining why their answer was wrong, they will try to force us to give them bonus points, or they will change their answer and try to manipulate credit.

It is amazing what people will do for a score when the solution is simple: Study and improve your skills, then take the test. However, some people feel it necessary to cut corners because they believe they are going to make money much faster. It is unfortunate they do not realize that attitudes like this actually lower their score. We believe that people who take short cuts with their own self-interests in mind will not be caring to debtors and will be inflexible when working with attorneys. Both of these qualities are very important to have as a virtual bankruptcy assistant.

The Solution I Have Implemented

To solve these problems I have decided to list the name, link and point score only, if the person achieved a grade of 90% or higher. Anyone who scores lower than 90% will still be listed on the NAVBA website but their exact score will not be mentioned and they will be listed in a separate area. Hopefully, this will prevent these past problems and help to keep the VBA Certification Exam an honest evaluation of the skills of a virtual bankruptcy assistant.

Update on VBA Exam

We have had a few people pay for the VBA Exam and then be unable to complete it. Therefore, I am issuing the information below to help those of you who plan to take the VBA Exam.

DEAR VICTORIA:

I passed Part 1 of the VBA Exam but as I reviewed my computers, I haven’t found another test so I believe that I will have to take an “F” for the computer portion (Part 2) of the test. I truly apologize for wasting your time and efforts.

Additionally, because I need to review the computer portion immensely, I wonder in order to take the test again, would I have to pay the original price? Would this include taking the written portion again?

Additionally, could you recommend any reviewing materials to give me better knowledge of Best Case and entering the information?

RESPONSE FROM VICTORIA:

The software program you use to take Part 2 of the VBA Exam should NOT be an issue. All bankruptcy software is basically the same because the Federal Forms of the bankruptcy petition are the same. Additionally, Best Case is not the only software program around. In fact, the company is having several internal problems at the moment so I would use caution in dealing with them right now. Suppose you work for an attorney who uses EZFiling or New Hope software instead? What would you do? Therefore, your focus should be on learning how to prepare a petition, not on the software program itself.

Do you have the 10 training videos I developed? This should be all you need to prepare the petition for the VBA Exam. Or, you can use any software program to take the test. Again, the issue is NOT the software. You are graded on your ability to know how to input a petition. If you are having these problems now, you are not ready to work for attorneys and input their petitions.

Our policy is to grade you on the VBA Exam you pay for. If you must stop in the middle (like you have done) and take a failing grade on Part 2, then you have failed the VBA Exam. This is necessary because the VBA Exam is a test for you in the “real world.” If you were to accept a petition from an attorney and then tell the attorney you needed time to learn a software program, you would jeopardize the life of an innocent debtor. I hope you can understand that the VBA Exam is designed to protect attorneys, the bankruptcy court and the debtors. If you have any problems taking the test, we can only assume you would have problems working for attorneys.

In case you were not aware, 713Training.Com has the ONLY developed test for attorneys to measure skills levels of those who prepare bankruptcy petitions. Therefore, I will design the Master Course so that 1/3 of it will be concentrated on teaching students marketing techniques. Also, I was amazed that 83.3% of the people want a set of standard operations procedures. This gives me several ideas for the development of new training products and I appreciate you bringing it to my attention.

COMMENT: I will do the best I can to keep the prices low. However, you need to remember that the average virtual bankruptcy assistant earns from $15,000 to $25,000 per month. There is NO college you can graduate from making that kind of money and people pay thousands of dollars to attend college for a period of 2-4 years. Because my overhead costs are low, I will not price the Master Course at thousands of dollars, but it will be priced higher than the $25 one of the survey respondents suggested.

You click on the link and immediately you are connected to the web conference. The old-fashioned way of attending meetings was to get up from your desk, walk to a meeting room, take a seat and listen to the speaker. Today, you simply attend on your computer screen. It is much easier and you do not even need to participate. Just watch your computer screen.

Why would 79.5% of the respondents want to know how to prepare a Chapter 7 from scratch and 82.2% want to know how to prepare a Chapter 13? Either the people responding to this survey had no clue who 713Training.Com was or they misunderstood the question. There would be no reason whatsoever to incorporate basic petition training into a Masters Course when I have spent the past 6+ years providing this training already. Besides, a person cannot even pass the standard VBA Certification unless they have basic Chapter 7 and Chapter 13 skills. FEEDBACK AND SUGGESTIONS:

I would love to see a lot of hands-on training, homework, quizzes, etc.; a chance to collaborate with other students regarding the projects – maybe a required online get-together at least once a week; a good feel for being taught in a small student environment with VBAs who are serious about their business and willing to work with the other students to enhance what we learn.

For me personally, I have education as a legal assistant but I have never worked in the legal field. My experience is with corporate attorneys. I would want to know whether the training is for experienced bankruptcy assistants either virtual or onsite assistants. I would be willing to pay more for training that provides a turn-key type of business. Also, the more business that is guaranteed to me as a result for completing training would be enticing and I would pay more for tuition. I hope this helps. Good luck with your program.

COMMENT: Thanks for your comments. Unfortunately, how to prepare a Chapter 7 or Chapter 13 bankruptcy petition is not a skill taught in any law school or paralegal program. That is why I developed the field because I saw a need for virtual bankruptcy assistants. However, your training as a legal assistant is excellent to have when working in different areas of bankruptcy. Bankruptcy is a field that utilizes almost all areas of law including real estate law, torts, corporate, business and many more.

Considering that there is only 1 individual training, Victoria, herself, I believe that Victoria should train others to help her with her overwhelming responses and testing. Allowing other individuals to help grade would shorten the period and response time of the testing procedures.

COMMENT: I totally agree but I have had no one accept my offer. First I developed an application for people who wanted to learn how to become training instructors. They were not required to pay a penny. I only asked them to meet me at seminars and attorney offices so I could provide them with on the job training before releasing them to train the virtual bankruptcy assistants. However, not one person took the time to even fill out the application. So I decided to develop an Apprentice program where I would set up their business for them. One lady applied for this program and paid $10,000. I spent almost $11,000 setting her business up (more than I received) in addition to over 100 hours of my own personal time. However, this lady turned around and filed a lawsuit against me for $35,000 (more than she even paid), which was later dismissed. I never found out why this lady got upset as she refused to communicate with me. In fact, I tried to send her the computer and software I purchased to set up her business and she refused shipment. After these mind-blowing experiences, you can understand why I am not excited about making the offer again. Therefore, if you are interested in becoming a training instructor and helping me with the tremendous workload please STEP UP TO THE PLATE.

I definitely think if virtual assistant were able to pay monthly for a course with Victoria, a lot more people would be able to attend. Not everyone has a large sum of money to spend at one time.

I would benefit most from courses that I could access when time permitted. My schedule as a signing agent and closing for two in-town Title offices is unpredictable at best. This is why I have shied away from paying for other classes offered that are only available at a certain time. College classes are now offering uploaded materials and the student accesses them, listens, learns, and takes an exam. This concept would work for me. Locked into a specific time table would not work. Love you Victoria – you are great!

The client intake forms that we have as a guide is not necessarily those of which a seasoned bankruptcy attorney uses. In my experience, when my mom went to do her bankruptcy, her attorney who has practiced Law in FL and CA for the past 20 years gave her one sheet that had all the necessary information required. Then when I watched her input the details into Best Case it was completed in a jiffy. I would suggest that a course be offered or a section be offered with the most common circumstances in the bankruptcy arena. This way it is also simplified for the VBA. When I took the course in Orlando with Angie Boyd, it was difficult to follow all that she was doing or saying especially to learn in so much detail in what was a day and I felt not wisely invested money to study under her direction. I had to purchase Victoria’s training DVD’s on top of that just to get an understanding.

COMMENT: First of all, Angie Boyd was fired back in October 2007 for theft of company property. (Refer to the article at http://www.servantofjesuschrist.com) She never stayed with me long enough to learn how to properly train students so I apologize that you were a victim of her sloppy and horrid training techniques. Putting that all aside, the Client Intake Forms were originally developed by seasoned bankruptcy attorneys. You cannot compare the 1 page form your mother used (probably before the law changed in 2005) with the entire industry. Besides, the Client Intake Forms were also tested in hundreds of client intake interviews and they have been downloaded and utilized by thousands of attorneys across the United States since 2001. Finally, I am not going to teach anyone how to take short cuts that end up harming innocent people. Your suggestions are based on a very limited knowledge of the bankruptcy industry.

There should be a section on writing a business letter to send out to the attorney. This will help those whom have not study for grammar and writing skills in years. There should be a mock phone or webcam interview with a practicing attorney in bankruptcy. This will help the assistant deal with daily attitude and personality in a law firm.

My personal goals, before I get my feet wet and market to attorney’s is to make sure I understand how to prepare the bankruptcy petitions, and I do understand that you may not know everything and will learn from mistakes when starting out, I just want some knowledge first. Learning how to use pacer, marketing tools, More detail if your chapter7 becomes a 13, setting up a business, motions and pleadings. I think what you have listed is a great start.

COMMENT: You may be interested to know that we did a teleconference on Motions and Pleadings, plus provided people with a huge set of templates in both debtor and creditor pleadings. I will hold another teleconference on this topic since some people may have missed it.

Judging from my biggest hurdle and worry, I would be more interested in this training if the cost of the BEST CASE software was included in the cost of the training. Reason being, I have purchased all the material to learn, I am slowly getting over my fears with marketing and landing clients; however, with struggling financially due to the current economy, I am scared I will be unable to afford the price of the licensing for BESTCASE and potentially lose my first client due to the delay of purchase. I know this is just my personal feeling, but I think including at least one licensing with the cost of the training would honestly set your students up with absolute success with no hurdles! Thanks for the opportunity to share my thoughts!

COMMENT: Best Case is not the only software program on the market. There are a lot more. For example, http://www.bankruptcysoftware.com provides a FREE software program for virtual bankruptcy assistants. It is the attorney that must pay for the license in order to be able to file. Other software programs are provided on the website at http://www.713training.com/links. Besides, you must consider that if you are unable to purchase the software to start your business you need to get the money you need before marketing. You never want to be placed in a position where you tell an attorney you cannot afford to buy the tools to do their work. This shows you to have an unstable company. Therefore, generate the money to purchase what you need for your business before you start it.

For example: If you decide to have a child, you need to prepare for that child by buying a crib, baby bottles and all the other baby supplies. If you do not have the money to afford these things you figure out ways to get them anyway. You certainly would not bring a new baby from the hospital naked with no clothes and no bed to lie in. The same holds true for your company. You do not birth a new company naked with no clothes and tell your potential customers about it. Doing so will only portray you in a bad light.

I would think this course would help those who want to pass the VBA Certification. This appears to be something separate. It appears to me that once you pass the VBA, you are eligible to receive referrals. But what will you get after this? You receive ONE attorney client. Are you going to develop a logo for those who have passed this course? I think the Masters class would focus on advanced skills. The basics should be left to the VBA Certification. And in terms of cost, I hope it won’t be out of reach.

The VBA is already $150. But in order to pass it you do need to purchase your other material, which costs. The one plus would be to teach on the bankruptcy code. I’ve taken paralegal classes here in Indianapolis, and I can tell you there is no bankruptcy classes offered. And I think when attorneys see that you have a grasp of it, the more appealing you are. The other class I would suggest is a course on the role of the Trustees. I have downloaded all of their manuals so that I have a better understanding of who they are. I currently look for their reports in my current position at the bank. So I know how important they are. To me they are critical in the bankruptcy process, especially when creditors have to appeal to them when borrowers give out faulty information about debt they are trying to discharge.

COMMENT: Thanks for your opinion. As far as developing a logo, I am currently focusing on the development of the material. The logo development is something I will think about when the course is finished. We cannot get the cart before the horse right now.

As far as there being no bankruptcy classes offered in debtor law, it all has to do with rich people only being concerned with rich people. You can find training in corporate law and big business Chapter 11s, but one of the reasons I developed the virtual bankruptcy assistant field was to bring training to the masses so they could help the average John Q Public – people who really need help. It is unfortunate that the goal of the rich is to keep the poor under them. That is why there has been so much resistance to education in Chapter 7 and Chapter 13. I hope all of those reading my words will join me in telling everyone you know about the virtual bankruptcy assistant field and explain to people that attorneys choosing to work in this area of law are normally attorneys who care about the general public. If they didn’t, they would be working in big business bankruptcy making all the big bucks.

In Max Gardner’s class he has a chart that simplifies the whole petition process and his intake form is devised to go from Schedule A-J contiguously, I don’t know if this is true but I spoke to an attorney who took his class and it sounded very interesting. Of course this class was only for attorneys. Also a class on how to finish the petition in 20-30 minutes or less. How to handle a high workload without stressing yourself out of control. How to keep quality control very high and your client’s content. How can we automate our process in the petition preparation to have an efficient smooth running system that works to our advantage almost flawlessly?

COMMENT: The solution to these issues is PRACTICE which is not a product I can develop. PRACTICE is up to you and is something only you have control over. There is no magic pill I can give you to teach you everything you need to know in 30 minutes or less. When you first learned how to drive a car, did you know as much then as you did 10 years later? When you began the first day of your current job, did you know all the shortcuts and time saving techniques as you do today? The only way for a human being to learn how to get faster at something, create less stress and develop quality control is to PRACTICE. It is therefore up to you to implement this technique which is something I cannot do.

I think that there should be a review of Chapters 7 and 13 preparation before moving on to the advanced skills to make sure everyone is “on the same page.” I also believe it is very important to not only study and analyze the code, but to actually understand it. It would also be very beneficial to the VBA and the attorney if VBA’s could prepare any motions or pleadings regarding the bankruptcy process. As a VBA, we should be knowledgeable and competent to assist the attorney during every step of the process. Knowing and understanding the bankruptcy process, not just how to fill out the forms, will make the VBA an indispensable asset to the attorney by providing the highest form of professional support to the attorney and, therefore, the client.

COMMENT: Your comments are insightful. I am developing an application process that will ensure that everyone is on the same page before they are accepted into the Master Course program.

However, a study of the Bankruptcy Code is not necessary for a virtual bankruptcy assistant. The attorney is the person who should concentrate on learning the Bankruptcy Code. The role of a virtual bankruptcy assistant is never to take the place of an attorney or risk committing unauthorized practice of law (UPL).

Additionally, learning how to write motions and pleadings is another skill that is only taught to law students and attorneys. Again, these skills are not taught to legal secretaries and paralegals because the law protects the public from unauthorized practice of law.

Besides, it is a proven fact that if a virtual bankruptcy assistant knows too much about the law itself, they have a tendency of committing UPL more frequently. That is why I only concentrate on the training a virtual bankruptcy assistant needs without committing UPL. When I train attorneys I concentrate on the Bankruptcy Code and the other areas of law you mention. Attorney training is not the same for virtual bankruptcy assistants.

Basic training/advance in the preparation of both Chapter 7 & 13. I think that Chapter 11 Business bankruptcy should be in a different training class. But to include the preparation of motions and other pleadings to give the Virtual Assistant the additional knowledge they would have to market their business. Possibly placing the business plan and the other items in Question #2 in a separate training session, so that the main focus is having a clear understanding of the preparation of the chapters.

COMMENT: Please see my answer below regarding big businesses and Chapter 11s. My focus is solely on helping the average John Q Public which makes up 80% or more of all bankruptcy petitions that are filed. If someone wants to work in Chapter 11s, there is enough training material on this area of law already. My focus and concern is people, not big businesses who have millions of dollars.

With regard to the general certification process, I would like to see made available additional Sample Client Intake Forms for training purposes (perhaps up to three). It appears the vast majority of trainees are new to the bankruptcy field (myself included) and having additional petitions to prepare would serve to not only boost our understanding of the process but also our confidence in marketing ourselves thereafter. I, for one, would gladly pay for your additional time in reviewing these additional training petitions.

COMMENT: I agree with you. In the past other people have suggested that I make a book of practice Client Intake Forms. The only reason I held off is because the solution is simple and will not cost you any money. Just do your own bankruptcy petition. No one will see the information and doing your own; (using your own debts and asset information) will advance your training skills much better than practicing on several bogus ones. Finally, since every bankruptcy petition is different and unique, you will never be 100% prepared until you jump in and start working for attorneys; no matter how many you practice on beforehand.

I think twelve weeks is a decent amount of time to get to the nitty gritty of a lot of the topics that would interest a lot of us. I have been looking into this industry for a long time, now is the time to get out here and do this, so providing the above listed topics would be a great starting point. I would also be interested in learning more about filing for businesses. I had one a little while back, but the paralegal I was working with to do petitions did not do business filings. I would really like to learn more about marketing other ways to grow a virtual bankruptcy business. I would also like to know more about how the process of filing for BK holds up foreclosure. Working for a major federal loan provider our borrowers do this, so I know private industry is doing the same, so in having potential clients who may come to me to file a petition, I would like to know more about this. This is great, thanks for this opportunity.

COMMENT: By filing for businesses, I do not know exactly what you mean. If someone has a business that makes under $1 million they can file a Chapter 13 or a Chapter 7 like any other consumer. (The amount changes all the time.) Chapters 11s are for businesses that make close to $1 million or more per year and have enough money to pay back their creditors. Even a billion dollar a year business can file a Chapter 7. Therefore, I do not understand why any paralegal that knew how to prepare Chapter 7s and Chapter 13s could not do a business filing. It is evident this paralegal either did not understand what you were asking or was unskilled in bankruptcy law.

I think it is a great opportunity, I would truly like the course to focus on Bankruptcy (7-13) and you might want to have but the bankruptcy questions before the business plan questions. The price might be a little steep for the course as well.

COMMENT: I addressed this issue before regarding price. My son Michael is getting ready to enter law school. He is willing to invest 4 years of his time and go into debt with student loans totaling $100,000 to become an attorney. Even with that, Michael will not immediately start earning $25,000 per month in income when he graduates from law school. But when you graduate the Master VBA Course and have been assigned an attorney client to work with, you will begin your career with a monthly starting income of $10,000 or more per month. If you are not willing to pay for good training in order to achieve this goal, then you are not ready for the Master Course.

They take you step by step in completing the bankruptcy petition and schedules and if you’ve never done one – you certainly would be able to do so after completion of following the book. I think a payment plan would be needed (could pay weekly or monthly). Have training online (username/password) so we can work into schedule, so you won’t miss anything and can go over assignments/topics several times for review. Have ongoing groups of 4 so you can start monthly instead of waiting 12 weeks before you can start again. Great Idea! Very interested. Thank you for all you do!

I feel that it is a great idea to develop the Master Virtual Bankruptcy Assistant Training Course. Depending on the fee, I may enroll. I am a Certified Virtual Bankruptcy Assistant, but I wish that I could have gotten some type of experience, perhaps through an internship program. In the future, I think it would also be a good idea if you could incorporate more practice with drafting the bankruptcy petitions. I look forward to hearing more about this course.

One Year Anniversary

My Christmas Day Blessing to You on December 25, 2008
Marking the One Year Anniversary of My Near Death Experience

For those of you who were customers this time last year, you may remember me publishing the article regarding my near-death experience. As many of you are aware, God intervened in my life and two angels appeared to me just before I came out of the 3 week coma that almost took my life. I wrote about the experience and published it as a testimony to Jesus Christ.

For this Christmas season, and to mark the 1 year anniversary of my healing, I have published the article on the front page at http://www.servantofjesuschrist.com Included with the article is proof of my experience through the Hospital Discharge and letter from the Columbus Health Department. Links to both of these documents are included in the article.

In reading this article, I do NOT ask for sympathy in any manner. Instead, I ask you to open your heart and acknowledge Jesus Christ for His miraculous healing and power beyond our human understanding. Although Jesus Christ was not born on December 25, you should still acknowledge His birth; which has given every one of us an opportunity to have eternal life.

I wish all of you a blessed and wonderful Christmas day.
